Since the overturning of Roe v. Wade, each state now decides what the limits on abortion will be for their own state. The North Carolina Senate enacted HB 20 which restricts abortion under certain circumstances, but some parts of it were enacted, some changed, and other parts have been challenged in the courts.
When is Abortion Legal in NC?
Abortion is legal in most cases through the 12th week (to 12 weeks 6 days from the first day of the last menstrual period)
NC Abortion Restrictions
Abortion is illegal after the 12th week (12 weeks 6 days) in most cases. There are exceptions for medical emergency as determined by a qualified physician, exceptions up to 20 weeks for rape or incest, and exceptions up to 24 weeks for life-limiting anomaly as determined by a qualified physician.
- Abortion is illegal if the woman is forced or coerced to abort
- The procedure known as “partial-birth abortion” or D&X is illegal
- Abortion is illegal for the purpose of terminating due to race, sex, or Down Syndrome
- Abortion is illegal without the woman’s Informed Consent 72 hours prior
- Abortion is illegal if it is provided outside of listed state requirements (includes pre-abortion ultrasound, credentials for abortion providers, transparency with patients, etc.)
- Minors must have parental consent (or judicial bypass) to obtain an abortion
- Babies born alive after a failed abortion are considered persons and are entitled to legal protections
